How to Enter
To enter, individuals must log onto www.netrewards.com.au, follow the prompts as directed to the competition entry page, input the requested details and submit the fully completed entry form, during the promotional period.
Terms & Conditions
1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to Australian residents aged 18 years and over. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.
3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
4. Incomplete or indecipherable entries will be deemed invalid. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
5. Only one entry permitted per person per day.
6. Promotion commences AEST 00.01am 01/02/10 and close AEST 9.50am on 27/04/10 (“Promotional Period”).
7. There will be one (1) draw conducted each Tuesday at 12 noon from 01/02/10 to 30/04/10 (“Draw Period”) inclusive (13 draws in total). Entries close at 3pm AEST on each day of the Draw Period. Draws that fall on a public holiday (in Victoria) will be drawn on the next working business day with the final draw being conducted on 30/04/10. All draws will take place at Loyalty Marketing, Suite 11, 210 Toorak Road, South Yarra, 3141 at 12 noon AEST each Tuesday of the Draw Period (or the following business day, as the case may be). Non-winning entries in each draw will be entered into any subsequent draws. Winners will be notified by mail and winners’ names will be published on www.netrewards.com.au and in The Australian on 15/03/10 (for winners of draws from 01/02/10 to 12/03/10 inclusive) and 03/05/10 (for winners of draws from 15/03/10 to 30/04/10 inclusive). The Promoter’s decision is final and no correspondence will be entered into.
8. The first valid entry drawn from all entries received in each of the weekly draws (“Participant”) will win the chance to spin for $1,000 by participating in the Event via telephone, which will be held on the same day as the draw. Any and all costs associated with participating in the Event are the sole responsibility of the Participant.
9. The Promoter will attempt to contact the Participant following the draw but before the Event via telephone using the details provided with the drawn entry, so that the Participant may participate via telephone. In the event that the Promoter has not been able to contact the drawn Participant before the commencement of the Event, a representative of the Promoter will participate in the Event on the drawn Participant’s behalf, and the prize won will be awarded to the original Participant drawn.
10. The Event There will be one (1) event conducted each Tuesday from 02/02/10 to 27/04/10 (“Event Period”) (13 events in total). Events that fall on a public holiday will be held on the next working business day with the final event being conducted on 27/04/10. Each Event will take place at Loyalty Marketing, Suite 11, 210 Toorak Road, South Yarra, 3141 at 10.30am AEST during the Event Period. The Event will be recorded and available to be viewed at www.netrewards.com.au. There will be 100 NetRewards segments numbered 1 to 100 placed in an opaque barrel at the commencement of the Event. The participant will select one number between 1 and 100 over the phone. One segment indicated by a golden key will represent the Major Prize for $1,000. The remaining 99 NetRewards segments will each represent the consolation prize. The Promoter, or Promoter’s Representative (“Attendee”) will be required to choose only one (1) of the numbered segments from the barrel. If the numbered segment selected by the Attendee represents the “Major Prize”, the drawn Participant will win the $1,000. If the numbered segment selected by the Attendee represents the Consolation Prize, the drawn Participant will win an iPod Shuffle valued at $76. In the event that a proxy of the Participant or a representative of the Promoter plays the Event on the Participant’s behalf, the prize selected in the Event will be awarded to the originally drawn Participant. Allow up to 28 days for delivery of the Major Prize. |
11. The odds of winning the Major Prize for $1,000 once drawn as the Participant, is 1:100.
12. Any cash prizes will be awarded in the form of a cheque.
13. Total potential prize pool is up to $13,000. Prizes or any unused portion of a prize are not transferable or exchangeable and cannot be taken as cash.
14. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
15. Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize at the time stipulated by the Promoter, then the prize will be forfeited.
16. A draw for any unclaimed prizes may take place on 06/07/10 at the same time and place as the original draw in order to award each unclaimed prize as originally determined in the Event for the relevant prize, subject to any directions from a regulatory authority. Winners’ names will be published on www.netrewards.com.au and, in the case of winners of prizes $250 and over, in The Australian on 09/07/10.
17. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner or Participant (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
18. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
19. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
20. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
21. As a condition of participating in the Event or accepting a prize, a Participant and/or winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
22. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, agents, contractors, service providers, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
