AUSTRALIAN VOLUNTEER COAST GUARD ASSOCIATION INC. "SCRATCH & WIN" 2008 PROMOTION

HOW TO ENTER

To be eligible to enter, individuals must, during the promotional period, donate a minimum of $10.00 in a single transaction to the Australian Volunteer Coast Guard Association Inc. (AVCGA) Fundraising Team to receive a scratch card. Scratch cards are strictly limited. Entrants will receive a scratch card for every $10.00 donated and a bonus scratch card if a donation of $50.00 is made in a single transaction. For the avoidance of doubt, if the entrant donates $50.00 they will receive 5 scratch cards plus 1 bonus scratch card (6 scratch cards in total).

The entrant must scratch their card to reveal whether or not they have won an instant prize. To claim a prize, entrants must either call the claim line number 1800 079 966 during business hours 9.00am - 5.00pm each week day and provide their name, address and contact phone number to receive their cash prize.  Or complete the details on the back of the ticket and send the ticket into Australian Volunteer Coast Guard Association Inc. "Scratch & Win" 2008 Promotion, Suite 11, 210 Toorak Road, South Yarra VIC 3141. In order to verify their claim, instant win cash prize winners will be required to send their winning scratch card to an address (notified to them at the time of their call) so that it is received by 5pm AEDST on 28/09/2009.  Allow 28 days for receipt of prize.

To enter the major prize draw, entrants must complete the back of their original game card by inserting their requested details and then send it to "Australian Volunteer Coast Guard Association Inc. Scratch & Win" 2008 Promotion PO Box 9199 South Yarra VIC 3141. Entries for the draw close last mail 28/09/2009. 

TERMS AND CONDITIONS

1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is only open to VIC residents aged 18 years or over. Employees (and their immediate families) and paid contractors of the Promoter and agencies associated with this promotion are ineligible to enter.

3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

4. Incomplete, indecipherable, or illegible entries will be deemed invalid.

5. Multiple entries permitted, subject to the following: (a) only one entry permitted per scratch card awarded; and (b) each entry must be submitted separately and in accordance with entry requirements.

6. Promotion commences on 03/10/2008 and closes 5pm AESDT on 25/09/2009. Entries close last mail on 28/09/2009.  All claims for instant win prizes must be received by 5pm AEDST on 28/09/2009. The draw will take place at Suite 11, 210 Toorak Road, South Yarra VIC 3141 on 29/09/2009 at 10am AEDST.

7. Instant winners will be notified immediately in writing and their names (for prizes over $250) will be published in The Herald Sun on 02/10/2009. Major prize draw winner will be notified by mail and their name will be published in The Herald Sun 02/10/2009.

8. The Promoter's decision is final and no correspondence will be entered into.

9. The first valid entry drawn in the major prize draw will win the choice of either:

(a) $20,000 cash awarded in the form of a cheque.

(b) Car/Travel Voucher to the value of $20,000

10. Any costs in excess of the value of any vouchers (if applicable), including GST, and all ancillary costs associated with redeeming the prize is the responsibility of the winner. The Promoter shall not be liable for a voucher that has been lost, stolen, forged, damaged or tampered with in any way. Redemption of all vouchers are subject to the terms and conditions specified on the voucher.

11. Instant win prizes: 490 x $5 cash prize; 400 x $10 cash prize; 50 x $20 cash prize; 30 x $50 cash prize; 20 x $100 cash prize; 8 x $500 cash prize; and 2 x $1000 cash prize. All instant win cash prizes will be awarded in the form of a cheque.

12. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

13. Total prize pool value is $36,950.00. 

14. Prizes, including any unused portion, are not transferable or exchangeable and cannot be taken as cash unless stipulated otherwise.

15. A draw for any unclaimed prizes may take place on 29/12/2009 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners' names (for prizes over $250) will be published in The Herald Sun on 31/12/2009.

16. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

17. Printing and other quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised prize pool will be honoured. Instant win game materials void if stolen, forged, mutilated or tampered with in any way. There will be a total of 54,000 instant win game cards printed for this promotion.

18. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) a prize.

19. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. Unless otherwise advised, the Promoter may also use the information for promotional, marketing and publicity purposes including sending electronic messages. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
