VICTORIA CRICKET ASSOCIATION TERMS AND CONDITIONS 1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. 2. Entry is only open to residents of Australia who can travel between 04/07/09 and 24/07/09. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. 3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 4. Incomplete, indecipherable, or illegible entries will be deemed invalid. 5. Multiple entries permitted, subject to the following: (a) only one entry permitted per scratch card awarded; and (b) each entry must be submitted separately and in accordance with entry requirements. 6. Promotion commences on 17/12/2007 and closes 5pm AESDT on 10/12/2008, Major prize draw entries must be received by this date. All claims for instant win prizes must be received by 5pm AEDST on 10/12/2008. Instant winners will be notified immediately and their names (for prizes over $250) will be published in The Herald Sun on 15/12/2008. 7. HOW TO ENTER - To be eligible to enter, individuals must donate a minimum of $10.00 in a single transaction to the Victorian Cricket Association between 17/12/07 and 10/12/08 to receive a scratch card. Scratch cards are strictly limited. Entrants will receive a scratch card for every $10.00 donated and a bonus scratch card if a donation of $50.00 is made in a single transaction. For the avoidance of doubt, if the entrant donates $50.00 they will receive 5 scratch cards plus 1 bonus scratch card (6 scratch cards in total). 8. The entrant must scratch their card to reveal whether or not they have won an instant cash prize. 9. Instant Win Cash Prizes to be Won: Cash prizes to be won instantly across the promotional period in $10.00 donation scratch cards are as follows: 490 x $5 cash prize; 400 x $10 cash prize; 50 x $20 cash prize; 30 x $50 cash prize; 20 x $100 cash prize; 8 x $500 cash prize; and 2 x $1,000 cash prize. All instant win cash prizes will be awarded in the form of a cheque. 10. How to claim Instant Win Cash Prizes: To claim an instant cash prize, fully complete the back of the original winning game card with requested details and mail to Victoria Cricket Association “Scratch & Win” Promotion, Suite 11, 210 Toorak Road, South Yarra VIC 3141 so that it is received by last mail on 10/12/08. For $1,000 instant win cash prize winners only, they need to call the claim line number 1800 079 966 during business hours 9.00am – 5.00pm each week day and provide their name, address and contact phone number to receive their cash prize. In order to verify their claim, $1,000 instant win cash prize, winners will be required to send their winning scratch card to an address (notified to them at the time of their call) so that it is received by last mail 10/12/08. Entrants who claim a cash prize will be automatically entered into the draw. Allow 28 days for receipt of prize. 11. Enter the Draw to Win $20,000 Cash or a Trip to the 2009 Ashes: To enter the draw to win, entrants must either: 12. The draw will take place at Loyalty Marketing, Suite 11, 210 Toorak Road South Yarra VIC 2141 on 11/12/08 at 4:00pm AEDST. The Promoter reserves the right to draw additional reserve entries, and record them in order, in the event that an invalid entry is drawn or an entrant is drawn who is ineligible. The winner will be notified by mail and the winner’s name will be published in the Herald Sun on 15/12/08. The Promoter’s decision is final and no correspondence will be entered into. 13. The first valid entry drawn will win a choice of either a $20,000 cash prize or a trip for two (2) people to the 2009 Ashes in the UK valued at up to AUD$20,000 depending on point of departure. Prize includes two (2) return economy airfares from winner's nearest capital city to London, UK, with stop overs in Hong Kong, China and Paris, France, 17 nights accommodation at a four star hotel, 2 exclusive tickets to 5 days of the Lord’s Test match, and airport to hotel transfers in Hong Kong, Paris and London. Spending money, meals, taxes, insurance, passports, visas, vaccinations, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are the responsibility of the winner and any companions (as incurred). The winner (and any companion) is responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and documentation required for travel. Prize must be taken on dates to coincide with the 2009 Ashes event and is subject to booking and flight availability. 14. Frequent flyer points will not form part of the prize. Winner may be required to present credit card at time of accommodation check in. 15. Prize is subject to the standard terms and conditions of individual prize and service providers. If for any reason a winner does not take the prize or an element of the prize at the time stipulated by the Promoter, then the prize or that element of the prize will not be redeemable for cash. 16. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, subject to any written directions from a relevant regulatory authority. 17. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority. 18. Total prize pool value is up to AUD$36,950. Prize, or any unused portion of the prize, is not exchangeable and cannot be taken as cash, unless specified. 19. A draw for the prize if unclaimed, may take place on 12/03/09 at the same time and place as the original draw, subject to any directions from a regulatory authority, in order to award a prize of equivalent value. Winner’s name will be published in the Herald Sun on 16/03/09. 20. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate. 21. Printing and other quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised prize pool will be honoured. Instant win game materials void if stolen, forged, mutilated or tampered with in any way. There will be a total of 54,000 instant win game cards printed for this promotion. 22. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the US Masters event is cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) use of the prize. 23. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter. 24.
