"PARALYMPICS SCRATCH AND WIN" 2008 - 2009 PROMOTION

HOW TO ENTER

To be eligible to enter, individuals must, during the promotional period, donate a minimum of $10.00 in a single transaction to the Paralympics Fundraising Team to receive a scratch card. Scratch cards are strictly limited. Entrants will receive 1 (one) scratch card for every $10.00 donated and a bonus scratch card if a donation of $50.00 is made in a single transaction. For the avoidance of doubt, if the entrant donates $50.00 they will receive 5 (five) scratch cards plus 1 (one) bonus scratch card (6 (six) scratch cards in total).

The entrant must scratch their card to reveal whether or not they have won an instant prize. To claim a prize, entrants must call the claim line number 1800 079 966 during business hours 9.00am – 5.00pm on any week day during the promotional period and provide their name, address and contact phone number to receive their cash prize.  In order to verify their claim, instant win cash prize winners will be required to send their winning scratch card to "Paralympics Scratch & Win 2008 Promotion" PO Box 9199 South Yarra, VIC3141 so that it is received by 5pm AEDST on 25/11/2009.  Allow 28 days for receipt of prize. Instant winners who send in their cards will be automatically entered into the major prize draw. The Promoter recommends that winners use registered post; however, this is not a condition of entry and the cost to do so will be the responsibility of the winner.

For non-instant winners to enter the major prize draw, they must complete the back of their original game card by inserting their requested details and then send it to "Paralympics Scratch & Win 2008 Promotion" PO Box 749 South Melbourne VIC 3205. Entries for the major prize draw close last mail 25/11/2009. 

TERMS AND CONDITIONS

1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is only open to VIC residents aged 18 years or over. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.

3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

4. Incomplete, indecipherable, or illegible entries will be deemed invalid.

5. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per scratch card awarded; and (b) each entry must be submitted separately and in accordance with entry requirements.

6. Promotion commences on 01/12/2008 and closes 5pm AESDT on 23/11/2009. Entries into the major prize draw close last mail on 25/11/2009. All claims for instant win prizes must be received by 5pm AEDST on 25/11/2009. The major prize draw will take place at Australian Paralympic Committee, Suite 10, Level 15, 470 Collins Street, Melbourne VIC 3000 on 26/11/2009 at 11am AEDST.

7. Instant winners will be notified immediately in writing and their names (for prizes over $250) will be published in The Herald Sun on 30/11/2009. Major prize draw winner will be notified by mail and their name will be published in The Herald Sun 30/11/2009. The Promoter’s decision is final and no correspondence will be entered into.

8. The first valid entry drawn in the major prize draw will win the choice of either:

      • $50,000 cash awarded in the form of a cheque; or
      • $50,000 Travel Voucher redeemable via World Wide Travel.

9. Any costs in excess of the value of any vouchers (if applicable), including GST, and all ancillary costs associated with redeeming the prize is the responsibility of the winner. The Promoter shall not be liable for a voucher that has been lost, stolen, forged, damaged or tampered with in any way. Redemption of any voucher is subject to the terms and conditions specified on the voucher.

10. Instant win prizes: 5,422 x $5 cash prize; 674 x $10 cash prize; 59 x $50 cash prize; 27 x $100 cash prize; 15 x $500 cash prize; and 3 x $1000 cash prize . All instant win cash prizes will be awarded in the form of a cheque.

11. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

12. Total prize pool value is $100,000. 

13. If the Travel Voucher is chosen by the winner as the major prize, then the voucher, including any unused portion, is not transferable or exchangeable.

14. A draw for any unclaimed prizes may take place on 26/02/2010 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners' names (for prizes over $250) will be published in the Herald Sun on 02/03/2010. For any unclaimed $5 or $10 instant win prizes, these prizes will be bundled into amounts of $100 and awarded to valid entrants drawn in the unclaimed prize draw. Any excess cash that does not fall within a $100 denomination will be awarded as a prize of the remaining amount (eg: if there is $545 worth of unclaimed $5 and $10 prizes, this will form 5 x $100 prizes, and 1 x $45 prize).

15. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

16. Printing and other quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised prize pool will be honoured. Instant win game materials void if stolen, forged, mutilated or tampered with in any way. There will be a total of 155,000 instant win game cards printed for this promotion.

17. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) a prize.

19. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and as required, to regulatory authorities. Entry is conditional on providing this information. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
